Judge Viviano’s Controversial Sentence

Therese Kozlowski was concerned about the threat to her life but despite this she requested a county jail term, which would be limited to one year. Judge Viviano sentenced Kozlowski below the standard range of between 19 and 39 months in a state prison, and far below Macomb County Prosecutor’s Office request and the Probation Department’s recommendation of 38 months.

After Viviano announced the two-month jail term, to be served on weekends, the Assistant Macomb Prosecutor Darra Slanec reacted by stating that is was a slap in the face of the victim. Slanec asked to redress the judge but Viviano denied her request.
